EU applications

The deadline to apply to the EU Settlement Scheme passed on 30 June 2021.

However, the Home Office have issued guidance saying they will accept late applications in certain circumstances.

If you are an EU / EEA / Swiss national and have not yet sought advice about your options to remain living and working in the UK, you should now do so urgently.

EU Settlement Scheme

Pre-Settled Status

EU / EEA / Swiss nationals who have been resident in the UK for less than 5 years can apply for Pre-Settled Status (Limited Leave to Remain). This gives the right to live and work in the UK for 5 years.

Family members can also apply as dependants.

They can apply for Settled Status after 5 years’ continuous residence and before their Pre-Settled Status expires.

Settled Status

EU / EEA / Swiss nationals who have been resident in the UK for 5 years or more they can apply for Settled Status (Indefinite Leave to Remain). This gives the right to live and work in the UK permanently.

Family members can also apply as dependants.

Family Permits

Family members of EU nationals who are outside the UK may still be eligible to apply for EU Settlement Scheme Family Permits if they were pre-existing family members on 31 December 2020.

Zambrano

EU and other nationals who are in the UK and are primary carers of British children may be eligible to apply under the EU Settlement Scheme to remain as their carers.

This is a route that has recently been opened further following a High Court decision. Our team can offer specialist advice on making an application on this basis.

Other options for working in the UK

Frontier Workers

EU nationals who were working in the UK before 31 December 2020 but still living in their home country can apply for a Frontier worker permit from January 2021.

This is a flexible option for EU nationals who continue to come to the UK regularly to work.

Business Visitors

An alternative option for EU nationals who wish to come to the UK for short periods for business is to enter as a Business Visitor.

This enables them to visit the UK for up to 6 months without applying for a visa and undertake certain limited business-related activities.

Work Visas

EU nationals who want to work in the UK from 1 July 2021 need to look to other work visa routes. Please see our Work Visas page.
